Term's of Service

By using the free web hosting service provided by Instant Pro Hosting, you agree to the following Term's of Service.

- Resource Allocation. You may only use the resources allocated to you. If you reach your limit, you will either not be able to create anymore of those particular resources or your account will be suspended from the Internet until the next month. You must not use your resources simply for back ups or storage. Everything stored in your account must be related to your website hosted on the Instant Pro Hosting network.

- Suspension. Instant Pro Hosting may suspend your account from the Internet for any reason. This includes breaching our Term's of Service. However, Instant Pro Hosting will always notify you of the accounts suspension so you may act upon it.

- Termination. Instant Pro Hosting may terminate your account and remove your data at anytime. Although Instant Pro Hosting will provide a detailed explanation before this action is taken. The decision to terminate your account is final.

- Unacceptable Content. You may not host or distribute any data or information that could be deemed unacceptable. This includes; Pirated Software, Child Pornography, Violations of Copyrights, Hacker Programs or Archives, file hosting/sharing scripts, Warez sites and hate propaganda. Accounts that host content that is deemed unacceptable by Instant Pro Hosting will be suspended until the content is removed.

- Server Security. Any attempt to undermine or cause harm to a server is strictly prohibited. Offenders will be prosecuted to the fullest extent of the law and your account will be immediately remove your account from the server without further notice. You may not host or transmit any type of computer virus that could harm the server or any other computers.

- Right to Refuse. Instant Pro Hosting reserves the right to suspend/terminate accounts if the decision to refuse service is made. This decision is made at at our sole discretion. This decision is final.

- Child Protection. If you wish to use this service you must be at least 13 years or older. Accounts where the owner is 13 years or younger will be removed from our network.

- Right to Service. We reserves the right at any time to modify or discontinue, temporarily or permanently, the system, or any part thereof with or without prior notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the system.

- Data backup and protection. Instant Pro Hosting is not responsible for any lose of data that occurs due to using our services. You recognize that its your sole responsibility to create periodic backups of your content.

- Instant Pro Hosting Advertising. Instant Pro hosting may occasionally send you special promotions and advertising in relation to your paid hosting service.

- Term's of Service. These Term's of Service may change at anytime without notice.

- One account per person. Every person is only allowed one account. If a user is found to own more than one account, all accounts will be terminated without notice.

- Customer details. The details collected by Instant Pro Hosting must be correct. You may not use a "spam" email address as your sign up email address. We must be able to verify your details at anytime. If you fail an email verification your account will be suspended until its passed.

- Spam. You may not use our service to distribute spam or bulk emails.

- Indemnification. The Customer agrees to indemnify and hold harmless Instant Pro Hosting, Instant Pro Hosting’s affiliates, and each of their respective officers, directors, agents, and employees from and against any and all claims, demands, liabilities, obligations, losses, damages, penalties, fines, punitive damages, amounts in interest, expenses and disbursements of any kind and nature whatsoever (including reasonable attorneys fees) brought by a third party under any theory of legal liability arising out of or related to the actual or alleged use of the Customer’s services in violation of applicable law or the AUP by the Customer or any person using the Customer’s log on information, regardless of whether such person has been authorized to use the services by the Customer.

- Disclaimer of Warranties. INSTANT PRO HOSTING DOES NOT WARRANT OR REPRESENT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. TO THE EXTENT PERMITTED BY APPLICABLE LAW INSTANT PRO HOSTING DISCLAIMS ANY AND ALL WARRANTIES INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. TO THE EXTENT PERMITTED BY APPLICABLE LAW, ALL SERVICES ARE
PROVIDED ON AN “AS IS” BASIS.

- Limitation of Damages. NEITHER PARTY SHALL BE LIABLE TO THE OTHER FOR ANY LOST PROFITS, OR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE LOSS OR DAMAGE OF ANY KIND, OR FOR DAMAGES THAT COULD HAVE BEEN AVOIDED BY THE USE OF REASONABLE DILIGENCE, ARISING IN CONNECTION WITH THE AGREEMENT, EVEN IF THE PARTY HAS BEEN ADVISED OR SHOULD BE AWARE OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING ELSE IN THE AGREEMENT TO THE CONTRARY, THE MAXIMUM AGGREGATE LIABILITY OF INSTANT PRO HOSTING AND ANY OF ITS EMPLOYEES, AGENTS OR AFFILIATES, UNDER ANY THEORY OF LAW (INCLUDING BREACH OF CONTRACT, TORT, STRICT LIABILITY, AND INFRINGEMENT) SHALL BE A PAYMENT OF MONEY NOT TO EXCEED THE AMOUNT PAYABLE BY CUSTOMER FOR THREE MONTHS OF SERVICE.
